Welcome to Reputation Harvest ("we," "us," or "our"). By accessing and using our services, the customer ("you," "your", "they") agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully before using our services.

1. Free Trial

We offer a 14-day free trial of our services to new users. During the free trial period, you will have full access to our service without any charge. Upon completion of the 14-day free trial, your subscription will automatically convert to a paid monthly subscription unless you cancel before the trial ends.

2. Subscription and Payment

After the free trial period ends, you will be automatically charged on a monthly basis unless you cancel the subscription. Payments are processed securely through Stripe. The subscription fee will be charged to the payment method you provided when signing up for the trial. We reserve the right to modify the pricing structure at any time, but we will notify you in advance of any such changes.

Billing Period: Monthly

Payment Method: Payments are processed through Stripe, and you must provide a valid payment method to continue using our services after the trial period.

Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel your subscription before the next billing period begins.

3. Access to Customer Data and Google My Business Profile

By using our service, you grant us access to the following data to provide our services:

Customer List: We require access to your entire customer list, including both existing and new customers. This access is necessary for us to assist with managing your customer relationships, improving service quality, and delivering personalised support.

Google My Business Profile: We also require access to your Google My Business profile. This access allows us to manage and optimize your business profile to enhance your online visibility, improve your customer engagement, and ensure that your business information is accurate and up-to-date.

You agree that we may use, store, and process this data in accordance with our Privacy Policy.

4. Customer Consent for Data Access

By agreeing to these Terms, you confirm that you have obtained all necessary consents and authorizations from your customers to share their information (e.g., customer lists) with us and to grant us access to your Google My Business profile for the purposes of providing our services. You are responsible for ensuring compliance with any data protection laws applicable to your customer data.

5. Cancellation and Refunds

You may cancel your subscription at any time. To cancel your subscription, you must notify us at least 5 working days before your next billing date. Cancellations can be requested via [method of cancellation, e.g., email, account portal, etc.]. In the event you fail to make a payment, we reserve the right to cancel the service with immediate effect.

Processing Time: Please note that cancellations take up to 5 working days to process.

No Refunds: We do not offer refunds for any partially used subscription periods, and no refunds will be provided after payment has been processed.

6. Data Protection & Security

We take your privacy seriously and implement reasonable physical, electronic, and administrative safeguards to protect your data. However, by using our service, you acknowledge that no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

7. User Responsibilities

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. Additionally, you are responsible for ensuring that all customer data provided to us is accurate, up to date, and in compliance with applicable data privacy regulations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Reputation Harvest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use or inability to use the service.

9. Intellectual Property

All content, including but not limited to text, graphics, logos, images, and software, is the property of Reputation Harvest or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any of our content without prior written consent.

10. Privacy

Your privacy is important to us. Our privacy policy, which is available on our website, governs the collection and use of your personal information, as well as the data we access through our services, including customer lists and Google My Business profile information. By using our service, you consent to the collection and processing of your customer data and business profile in accordance with our privacy policy. Additionally, payments are processed through Stripe, and their privacy policy is also applicable to the payment process.

11. Third-Party Services

Our service uses third-party service providers, such as Stripe for payment processing and Google for managing your Google My Business profile. These services are subject to their own terms and privacy policies. We encourage you to review the privacy policies and terms of these third-party providers. We are not responsible for any issues arising from the use of these third-party services.

12. Service Availability

While we strive to ensure the availability of our service at all times, there may be occasional downtime due to system maintenance, upgrades, or other unforeseen circumstances. We are not liable for any loss of service during these periods.

13. Dispute Resolution

Any disputes arising out of or related to these Terms and Conditions shall be resolved through binding arbitration in the United Kingdom. You agree to waive any right to a trial by jury or class action in connection with any such dispute.

14. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to, natural disasters, strikes, failure of electronic or communications systems, acts of war, or governmental restrictions.

15. Indemnification

You agree to indemnify, defend, and hold harmless Reputation Harvest, its officers, directors, employees, and agents from any claims, losses, or damages, including legal fees, resulting from your breach of these Terms, misuse of our service, or violation of any applicable laws or third-party rights.

16. Termination

Either party may terminate this agreement at any time by providing written notice to the other party. We reserve the right to suspend or terminate your access to our services if we believe you have violated any of the Terms. Upon termination, you will no longer have access to our services, and any outstanding payments must be settled.

17. Right to Modify Terms

We reserve the right to modify or update these Terms at any time, and any changes will be effective immediately upon posting. We encourage you to review these Terms periodically to stay informed about any changes.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.19.
